For some people the depths of their fear cannot be measured. Fear of 'Them', of the government, of 'turrurists', of losing their rights. Fear, Fear, FEAR! How they live like this I cannot imagine.
Today, I received another email from one of my brothers asking me to sign an online petition to keep Obamacare from taking our guns.
"I have to remember to unfriend him on Facebook,” I thought, as I hit delete on his message. “He is completely unhinged."
But then I reconsidered, rooted through the trash and clicked on the link to see what exactly was going on here. I haven't read the law. Maybe I'm wrong. The website - www.causes.com - is nice. Anyone can sign up and ask for help regarding a particular cause or issue. But, as with anything else, buyer beware. Misinformation and outright lies abound. This is not unexpected. It is the internet, after all.
This particular cause was labeled "Protect Our Right To Keep And Bear Arms." Apparently, according to 'Conservative Corps' who created the cause, under "Obamacare":
a federal mandate would wave federal privacy laws which would require that all mental health doctors turn over private information on gun owners.
Hmmm? This seemed problematic and honestly I had no idea of its veracity. So I did what everyone should. I downloaded the law - The Affordable Care Act (ACA), as it is properly known. It’s free, in PDF format and anyone can read it.
Guess what? After reading through much of it and then searching the law for keywords no such mandate, section or wording exists. Not on any of the 2,409 pages. Imagine that. Another gun rights lie fabricated to spread fear. This one was propagated by Gun Owners of America (GOA), who may or may not be behind "Conservative Corps". GOA was formed in 1975 by H.L. Richardson who, as a Board Member of the NRA, didn’t believe the NRA was hard-core enough. That’s right, GOA is MORE conservative than the NRA, and, apparently, they have no qualms about lying in order to feed conservative fears.
So, what does the ACA say about gun ownership and, in particular, about data collecting? It’s real simple.
From page 2038 of the Affordable Care Act:
(1) WELLNESS AND PREVENTION PROGRAMS.— A wellness and health promotion activity implemented under subsection (a)(1)(D) may not require the disclosure or collection of any information relating to—
(A) the presence or storage of a lawfully- possessed firearm or ammunition in the residence or on the property of an individual; or
(B) the lawful use, possession, or storage of a firearm or ammunition by an individual.
(2) LIMITATION ON DATA COLLECTION.—None of the authorities provided to the Secretary under the Patient Protection and Affordable Care Act or an amendment made by that Act shall be construed to authorize or may be used for the collection of any information relating to—
(A) the lawful ownership or possession of a firearm or ammunition;
(B) the lawful use of a firearm or ammunition; or
(C) the lawful storage of a firearm or ammunition.
(3) LIMITATION ON DATABASES OR DATA BANKS.—None of the authorities provided to the Secretary under the Patient Protection and Affordable Care Act or an amendment made by that Act shall be construed to authorize or may be used to maintain records of individual ownership or possession of a firearm or ammunition.
That's right. The ACA explicitly forbids the collection of any information regarding gun ownership. Firearms and guns are not listed anywhere else in the entire law. Kind of squashes the whole argument, doesn't it. But you know, it's become more of a battle-cry than it was ever a fact, anyway. In the end, "Obamacare is scary and ther comin fer are guns" is just another right-wing outrage fueled by misinformation and outright lies.
